Privacy Policy

This Privacy Policy describes the information Nurture, LLC (“Nurture”, “we”, “our”, or “us”) collects, how we use this information, with whom we share it, and the choices you have in connection with these practices.

Applicability

This Privacy Policy applies to any and all websites or other digital products made available by Nurture (the “Websites”) that link to this Privacy Policy.

Information collection and use

A. Categories and Sources of Personal Information

In the preceding 12 months, Nurture collected and disclosed the following categories of personal information: 

  • Personal and online identifiers (such as name, email, or other unique identifiers)

  • Payment information (such as credit card or other financial information)

  • Protected classifications (such as gender)

  • Commercial or transaction information (such as records of products or services purchased, obtained or considered)

  • Internet and other electronic network activity information (such as browsing history, search history, or interactions with the Websites)

  • Geolocation information

  • Professional or employment-related information (such as healthcare license information)

  • Sensitive personal information (which may include, depending on applicable law, health information, account credentials, payment card data for payment, precise geolocation data, or race/ethnicity), 

  • Inferences drawn from the above information about your predicted characteristics and preferences 

  • Other information about you that is linked to the personal information above.

We collect personal information from you, healthcare professionals, our affiliates and joint venture partners, our business partners, our service providers, and advertising companies and networks.

B. Information We Collect From You

Nurture will collect personal information from you when you:

  • Complete coverage or reimbursement forms: If you are seeking coverage assistance or reimbursement for a medical product, we or our service provider will collect your personal identifiers (name, physical address, telephone number, email address, and signature), your medical information (diagnosis, prescription, healthcare provider, and health insurance information). If you are a healthcare professional, we will collect your personal identifiers (name, physical address, telephone number, email address, Tax Identification Number, National Provider Identifier (NPI), and signature). We use this personal information to ensure you receive your Nurture products and to communicate with you.

  • Contact us: When you contact us or use an online chat feature, we collect your personal identifiers (name and email address) and any other information you choose to provide. We use this personal information to respond to your questions or inquiries, troubleshoot where necessary, and address any issues you may have.

  • Create an account: When you create an account, we will collect your personal identifiers (name, date of birth, email address, zip code, and selected password), and in some cases, information about health (conditions, provider information) for you or someone for whom you provide care.  We use this personal information to create and maintain your account and to communicate with you.

  • Make a payment: If you make a payment, we will collect from you, with the assistance of a third party, your personal identifiers (name, physical address, telephone number, and email address), your commercial information (invoice number), and your payment information (payment card number, Card Verification Value (CVV), and expiration date). We use this personal information to process your payment. Please note our payment processor collects and processes this personal information on our behalf and Nurture only retains historical payment information.

  • Make a purchase: If you purchase our products online, we will collect your personal identifiers (name, physical address, telephone number, and email address) and your payment information (payment card number, CVV, and expiration date). We use this personal information to process your payment and to fulfill and manage your purchase.

  • Participate in a sweepstakes, grant program, or other promotion (“Promotion): If you participate in a Nurture Promotion, we may collect certain of your personal identifiers (name, email address, mailing address) or any other information you choose to provide. We use this personal information to administer the sweepstakes and to communicate with you about the sweepstakes. For information on our information practices with respect to a particular sweepstakes, please refer to the official rules of the sweepstakes.

  • Participate in an online community: To participate in certain online communities, you will need to create an account. To do so, we will collect your personal identifiers (name, email address, selected username and password), and in some cases, information about health (conditions, provider information) for you or someone for whom you provide care. We use this personal information to create your account, facilitate access to the online community, communicate with you, provide you with relevant content and advertising, and monitor and operate the online community. As you use the online community, we will collect any other information you choose to disclose. Please keep in mind that any information you post is available to be viewed by the public. You should exercise caution in determining what information you post. Nurture cannot prevent further disclosure of information from your posts and is not responsible in any way for such use of the information. You should carefully review the Terms of Use of any online community you participate in as they may contain additional important information.

  • Participate in a survey, research panel, conference-related questioNurtureire, early-experience or in-home-use program: If you participate in a survey, research panel, conference-related questioNurtureire, or an early-experience or in-home-use test program, we may collect your personal identifiers (name, email address, mailing address, telephone number) and any other information you choose to provide in your responses. Depending on the program, we may also collect demographic information (such as age range or household composition), information about your experience with our products or professional information if you are a healthcare professional (such as specialty, practice information, or National Provider Identifier (NPI)).  We use this personal information to administer the program, evaluate product performance, conduct research and analytics, improve our products and services, and communicate with you.

  • Request a coupon referral pad (healthcare professionals): When you request a coupon referral pad, we will collect your personal identifiers (name, physical address, state license number, telephone number, and email address). We use this personal information to assess your request and to communicate with you.

  • Request a sample: If you request a product sample for yourself or an individual for whom you provide care, we may collect your personal identifiers (name, email address, physical address, and telephone number), health condition, and healthcare provider information. If you are a healthcare provider requesting a sample on behalf of your patient, we may collect the patient’s personal identifiers (name, email address, date of birth, telephone number, and physical address) and the patient’s medical information (condition). If you are a healthcare provider requesting a product sample for your facility, we will collect your personal identifiers (name, email address, facility address, and telephone number.  We use this personal information to communicate with you and to fulfill and manage your sample request.

  • Submit a bulk or wholesale inquiry: When you submit an inquiry, we will collect your personal identifiers (name, email address, telephone number, and physical address) and any other information you choose to include in your correspondence. We use this personal information to respond to your inquiry and communicate with you.

  • Subscribe for coupons and updates: If you elect to receive Nurture coupons or updates, we will collect your personal identifiers (email address, date of birth, and zip code). We use this personal information to fulfill your request to receive coupons and information on Nurture we feel may be of interest to you and to provide you with relevant content and advertising.

Nurture may also use your personal information collected for the above purposes to comply with the law and for other limited circumstances as described in INFORMATION SHARING.

C. Information Collected Automatically

In addition to the personal information you provide directly, Nurture (and other entities) may also collect information from you automatically as you use our Websites via cookies and similar technologies. This includes the following internet or other electronic network activity information:

  • Usage information: We (and other entities) use essential, performance, analytics, and advertising cookies and similar technologies to collect information about your interaction with our Websites, such as the pages you visit, the frequency of access, how much time you spend on each page, what you click on, and referring website address. 

  • Device information: We (and other entities) use essential, performance, analytics, and advertising cookies and similar technologies to collect certain information about the device you use to access our Websites, such as browser type, browser language, hardware model, operating system, and your preferences. 

  • Location information: We (and other entities) use essential, performance, analytics, and advertising cookies and similar technologies to collect information about your general location, which may be determined through your IP address. In some cases, and with your permission, we may also collect precise geolocation information.  

We use this usage, device, and location information to: (i) conduct analytics; (ii) enhance user experience; (iii) provide you with interest-based online advertising and measure the effectiveness of our advertising; (iv) prevent fraudulent use of the Websites; and (v) diagnose and repair errors.

In general, to disable cookies and limit the collection and use of information through them, you can set your browser to refuse cookies or indicate when a cookie is being sent; however, if you use these tools, our Websites may not function as intended. 

As our cookie banner explains, we will use cookies (including similar technologies) to collect and allow third parties to collect data from our website unless you select different preferences.  We record your preferences when you interact with our cookie banner or preference center. Your selections are stored through a preference cookie solely for the purpose of remembering your choices. Unless you clear your cookies or modify your preferences earlier, your consent choices will remain in effect for three hundred sixty-five (365) days from the date of your selection. After this period, or if the preference cookie is otherwise deleted, you will be asked to confirm your preferences again when you return to our website.

To modify your cookie preferences, you can clear cookies through your browser settings. After doing so, the cookie banner will automatically re-display upon your next visit, enabling you to update your choices.

D. Digital Advertising and Analytics

We may partner with ad networks and other ad serving providers (“Advertising Providers”) that serve ads on behalf of us and others on non-affiliated platforms.  Some of these ads may be personalized, meaning that they are intended to be relevant to you based on information Advertising Providers collect about your use of the Websites and other sites or apps over time, including information about relationships among different browsers and devices.  This type of advertising is known as interest-based advertising. 

To opt-out of interest based advertising generally or to learn more about the use of this information, you can visit the Network Advertising Initiative or the Digital Advertising Alliance. You can also exercise choices regarding interest-based advertising on your mobile device by downloading the appropriate version of the DAA’s AppChoices tool at https://youradchoices.com/appchoices.  If you change computers or browsers, use multiple computers or browsers, or delete your cookies, you may need to repeat this process for each computer and each browser.

Particular third-party cookies to note on our Websites include the below. Please note the use of these cookies may be considered a “sale” as defined by applicable state privacy laws.

We may also work with third parties that collect data about your use of our Websites and other sites over time for non-advertising purposes.  We use Google Analytics and other third-party services to improve the performance of our Websites and for analytics and marketing purposes. The Google Analytics Terms of Use and Privacy Policy describe how Google may use and share the information collected by Google Analytics. To prevent your data from being used by Google Analytics, you can download the Google Analytics opt-out browser add-on.

Information sharing

Nurture may share the personal information identified in this Privacy Policy in the following instances:

  • Within Nurture: We may share your personal information within Nurture and with our affiliates and subsidiaries in order to carry out our business and to the extent permitted by law.

  • In the event of a corporate reorganization: In the event that we enter into, or intend to enter into, a transaction that alters the structure of our organization, such as a reorganization, merger, acquisition, sale, joint venture, assignment, consolidation, transfer, change of control, or other disposition of all or any portion of our assets, we would share your personal information with third parties, including the buyer or target (and their agents and advisors) for the purpose of facilitating and completing the transaction. We would also share your personal information with third parties if we undergo bankruptcy or liquidation, in the course of such proceedings.

  • For legal purposes: We will share your personal information where we are legally required to do so, such as in response to court orders, law enforcement or legal process, including for national security purposes; to establish, protect, or exercise our legal rights, as required to enforce our terms of use or other contracts; to defend against legal claims or demands; to detect, investigate, prevent, or take action against illegal activities, fraud, or situations involving potential threats to the rights, property, or personal safety of any person; or to comply with the requirements of any applicable law.

  • For a business or commercial purpose: We may share your personal information for our commercial and business purposes.  In the preceding 12 months, we have shared: 

    • The categories of personal information described in CATEGORIES AND SOURCES OF INFORMATION with service providers that perform services on our behalf in connection with the Websites. These service providers include our IT support, communications vendor, payment processor, legal and risk, data analytics providers, carrier services, and similar services.

    • Personal and online identifiers and internet and other electronic network activity information with IT support to detect security incidents, protect against malicious, deceptive, fraudulent, or illegal activity, identify and repair errors, and to maintain and improve the Websites.

    • Personal and online identifiers, commercial or transaction information, internet and other electronic network activity information, and other information linked to this information for research and development purposes to better understand how to improve our products and services.

  • For interest-based advertising: Nurture does not sell personal information for money. However, Nurture does share personal information with third parties that may be considered a “sale” as defined by applicable state privacy laws. In the preceding 12 months, Nurture has shared personal and online identifiers and internet or other electronic network activity information  with Advertising Providers. To opt-out of processing and sharing of personal information for targeted advertising, you can activate the Global Privacy Control (“GPC”) by implementing a browser or extension that offers this control.  The GPC is a third-party tool.  More information and instructions on implementing this tool are available here

With your consent.  

Nurture may also share information with other parties with your consent or as otherwise disclosed at the time of data collection or sharing.

We may use and share deidentified information (including aggregated information) to the extent permitted by applicable law.  When we use deidentified information, we maintain and use the information in deidentified form and do not attempt to reidentify it, except to check whether our deidentification processes satisfy the requirements of applicable law.

Third-party links and tools

The Websites may provide links to third-party websites or apps.  We do not control the privacy practices of those websites or apps, and they are not covered by this Privacy Policy.  You should review the privacy policies of other websites or apps that you use to learn about their data practices.

The Websites also include integrated social media tools or “plug-ins,” such as social networking tools offered by third parties.  If you use these tools to share personal information or you otherwise interact with these features on the Websites, those companies may collect information about you and may use and share such information in accordance with your account settings, including by sharing such information with the general public.  Your interactions with these third-party companies and your use of their features are governed by the privacy policies of the companies that provide those features.  We encourage you to carefully read the privacy policies of any accounts you create and use.

State Privacy Rights

Some states grant certain rights to their respective State residents. If our processing of your personal information is subject to an applicable state privacy law, the following rights may be available to you, subject to certain exceptions and limitations:

  • Right to confirm: You may have the right to confirm whether we are processing personal information about you.

  • Right to know categories: You may have the right to request the categories of personal information we have collected, used, disclosed, and sold about you; the categories of sources from which we collected personal information about you; our purposes for collecting or selling personal information about you; the categories of personal information about you that we have sold or disclosed for a business purpose; and the categories of third parties with which we have shared personal information. 

  • Right to obtain a third-party list: Depending on your state, you may have the right to receive a list of the categories of third parties or specific third parties to which we have disclosed personal information. 

  • Right to access: You may have the right to access the specific pieces of personal information we have collected about you and/or request a copy of the personal information we have collected about you in a portable and readily useable format, to the extent feasible.

  • Right to correct: You may have the right to request that we correct inaccuracies in the personal information we have collected about you.

  • Right to delete: You may have the right to request the deletion of personal information that we collect or maintain about you.

  • Right to opt out: You may have the right to opt-out of (1) the sale of personal information or (2) the processing of personal information for targeted advertising. Please note that if you opt out of certain practices, we may be unable to provide you with some services.  Additionally, we do not knowingly sell or share personal information of individuals under 16.

  • Right to non-discrimination: You have the right to not receive discriminatory treatment when you exercise your privacy rights available under these laws.

  • Right to opt out of sensitive data processing:  Depending on your state, you may have the right to (1)request that we limit our use of your “sensitive” personal information, including health data; or (2) withdraw consent for such processing if you previously gave it.

Additionally, depending on your state of residence, if you have submitted a request that we have not reasonably fulfilled, you may contact us to appeal our decision by submitting a request via our interactive webform.

For requests submitted via telephone, you must provide us with sufficient information that allows us to verify you are the person about whom we collected the personal information and describe your request with sufficient detail to allow us to properly evaluate and respond to it. Our interactive webform contains all information we require to process your request. 

Depending on your state of residence, you may designate an authorized agent to make requests on your behalf by designating such an agent in writing or through a power of attorney.  If you are an authorized agent making a request on behalf of another individual, you must provide us with signed documentation that you are authorized to act on behalf of that individual.

Data retention

We will retain each category of personal information we collect in accordance with applicable laws and as reasonably necessary for our processing purposes set out under this Policy. When it is no longer necessary to process personal information for these purposes, we will deidentify, aggregate, or delete this data to the extent possible.

Marketing emails

You may opt-out of receiving marketing emails from us by clicking the “choice/opt-out” link provided with each email. Please note that we will continue to send you emails necessary to the Websites, related to our transactions with you (such as order confirmations), or for any assistance you request.

Information security

We implement and maintain reasonable security measures to help protect the personal information we collect and maintain. However, no security measure or modality of data transmission over the Internet is 100% secure and we are unable to guarantee the absolute security of the information we have collected from you.

Changes to this Privacy Policy

We may change this Privacy Policy from time to time. We will post the changes to this page and will indicate the date the Privacy Policy was last updated. We encourage you to review our Privacy Policy to stay informed. If we make changes that materially affect your privacy rights, we will notify you with a prominent post on our Websites and obtain your consent, if required.
